Military Parole in Place (military PIP) lets an undocumented spouse, parent, or child of a U.S. Armed Forces member — active duty, reservist, or veteran — stay in the United States lawfully while pursuing a green card, without having to leave the country first. Who Qualifies for Military Parole in Place

Military PIP is available to the spouse, parent, or unmarried child under 21 of:

• An active-duty member of the U.S. Armed Forces
• A member of the Selected Reserve of the Ready Reserve
• A current or former member of the U.S. Armed Forces, the Selected Reserve, or the Individual Ready Reserve who served on active duty

It's granted case by case under INA §212(d)(5), based on the hardship deployment or separation would cause the service member's family — not as an automatic entitlement.

Why This Matters for Green Card Eligibility

Most people who entered the U.S. without being inspected and admitted can't adjust status here; they'd normally have to leave for an immigrant visa interview abroad, which can trigger a multi-year unlawful-presence bar. Parole in place changes that. Once granted, USCIS treats the family member as "paroled" into the U.S., which satisfies the inspection-and-admission requirement for adjustment of status — meaning a spouse, parent, or child of a qualifying service member can often apply for a green card from inside the U.S. instead of risking that bar.

How the Process Works

• Form I-131 (Application for Travel Document): Filed with evidence of the family relationship and the service member's military status.
• Evidence of hardship: Documentation showing why the family's separation — through deployment, a future overseas posting, or removal proceedings — would harm the service member or unit readiness.
• USCIS discretionary decision: Parole is granted in one-year increments and can be renewed while the case moves forward.
• Adjustment of status: Once paroled, we file Form I-485 to pursue the green card itself.
