Law360, New York (December 23, 2015, 9:01 PM ET) — The rights of a Mexican woman were violated when an Immigrations and Customs Enforcement agent told her during removal proceedings that an “attorney could not help her,” the Ninth Circuit ruled Wednesday, reversing a California federal judge’s ruling.

In a 2-1 published decision, a majority of judges on the appeals court panel said it was at least plausible that Xochitl Cisneros-Rodriguez would have applied for, and been granted, a U-visa had the agent properly advised her of her right to have an attorney. U-visas allow crime…
