Law360, New York (December 14, 2015, 3:03 PM ET) — A sharply divided Second Circuit voted Friday not to review a decision that revived claims in a proposed class action accusing high-level law enforcement officials of contributing to the abuse of immigrants who were detained in the wake of 9/11 because they were Arab, Muslim or stereotyped that way.
By a 6-6 vote, the full circuit court denied requests that it rehear the appeal and dismiss claims against former Bush administration officials including ex-Attorney Gen. John Ashcroft and ex-FBI Director Robert Mueller. A majority is needed…
