Law360, New York (December 15, 2015, 1:55 PM ET) — A split Ninth Circuit on Monday upheld a decision that found a man’s conviction in California for committing lewd acts with a child was a serious crime that prevented him from trying to stop his removal from the U.S.

In a 2-1 decision, a panel of judges for the appeals court said the Board of Immigration Appeals did not abuse its discretion when it found Rutilio Landaverde’s 1998 conviction was a “particularly serious crime” under the Immigration and Nationality Act.
