Law360, New York (September 15, 2016, 7:50 PM EDT) — The Ninth Circuit ruled Wednesday that a lower board correctly found that an immigrant wasn’t “admitted in any status” for cancellation of removal purposes when he was recorded as a beneficiary on his mother’s asylum application, rejecting his petition for review.
In a published decision, a three-judge panel for the Ninth Circuit rejected a petition from Juan Carlos Fuentes, an immigrant who sought review of a Board of Immigration Appeals decision nixing his appeal over a denial of his cancellation of removal application.
