Law360, Washington (September 28, 2016, 9:12 PM EDT) — Koch Foods of Mississippi LLC cannot compel the release of identifying visa application information on employees who brought a sexual harassment suit against it, the Fifth Circuit ruled Tuesday, finding that a lower court’s decision to grant access to U Visa application information could dissuade immigrant victims from bringing complaints in the future.
The court remanded the case to the Mississippi district court to allow admission of employees’ U visa application information that maintains anonymity for the applicants and their families.
