Law360, New York (October 12, 2016, 6:48 PM EDT) — The First Circuit delivered stern rebuke to the Board of Immigration Appeals in a case involving a young Peruvian man who was ordered deported after mistakenly arriving late to his hearing, saying the board failed to distinguish his “uncharacteristic” lateness from refusing to appear at all.

In a published ruling, a First Circuit panel remanded the case of 26-year-old Daniel Emerson Murillo-Robles, who had become a lawful conditional U.S. resident at the age of 11 but found himself in deportation proceedings following an attorney misstep….
